Missed call text back for law firms: what the first text should and should not say

A missed call to a law firm may be a person in trouble. What the first text should say, what it must never say, how to handle urgency, and how to keep the conversation appropriate for text.

For a law firm, a missed-call text should identify the firm, say someone will respond, ask whether there is an urgent deadline or court date, and invite the caller to share only their name and the best way to reach them. It must never give legal advice, characterise their situation, or ask for the details of their matter by text. The goal is to keep a prospective client from calling the next firm while routing urgent matters to a person quickly.

Why law firms miss calls

Attorneys are in court, in meetings or on other calls, and small firms often have one person at the front desk. A person facing an arrest, an eviction or a served lawsuit will call several firms in a row. The first firm to respond appropriately often gets the consultation.

The first text

"Hi, this is Ortiz Law. Sorry we missed your call. If you have a court date or deadline this week, please reply URGENT. Otherwise, reply with your name and the best time to reach you, and we will be in touch today."

It asks for the one thing that changes the response (urgency) and the minimum needed to call back.

What it must not say

Urgency

"URGENT", "court", "arrest", "hearing", "served", "deadline" should reach a person immediately, with the caller's number. If nobody is available after hours, the reply should say when the firm will respond, and, where appropriate, suggest contacting emergency services or the court directly.

Confidentiality

Text is not the place for the facts of a matter. Keep the conversation to scheduling and routing. The consultation is where the story is told, under the protections that apply there.

Disclaimers

Your bar's rules on advertising and communications apply to automated messages. Many firms include a short line such as "This message does not create an attorney-client relationship." Review the wording with that in mind.

Frequently asked questions

Is texting a prospective client appropriate?

Many firms do, for scheduling. Keep substance out of the thread and follow your state bar's guidance.

What if the caller texts details anyway?

Do not engage with the substance by text. Move to a call or consultation.

Should the text say it is automated?

Yes, briefly. It sets expectations and avoids implying an attorney is responding.
